Predial Tax Discounts 2018 in Playa del Carmen

Get an early bird discount on your predial tax and save! If you are lucky enough to live in the Riviera Maya, surely you are getting ready for the holidays: family, delicious meals, parties. The high season is one of the best times for residents, there are plenty of tourists and snowbirds spending money, so financially is a good moment for everyone.

It is easy to go crazy with the expenses during the holidays, and be broke for the beginning of the next year. So it is important to keep your expenses low and try to use this money wisely, and what better way to use the extra cash than paying your Property tax?

What is the Predial Tax?

The Property tax in Mexico (Predial), is a tax paid to the county government, for the right to own real estate property. This payment is made once a year and allows the local government to cover expenses like: trash collection services, roads, maintenance of parks, and every other thing needed to run the city.

Predial Tax is based on the value of your property and the payment must be made during the first two months of the year. It is important to pay on time to avoid late fees, although some municipalities offer discounts on fines a few times a year.

Early Bird Discounts

The Riviera Maya counties such as Solidaridad and Tulum, offer special Early bird discounts for the landowners that pay the predial in advance. This not only allows the taxpayer to use the extra cash earned on december to pay in advance, but also to get a big discount.

In addition to this benefit, the government has a lower rate for retirees, pensioners and people over 60 years of age.

Requirements

Paying your property is easier than you think. In general, you only need to present the payment receipt of the previous year. Or, provide your property registry number (cedula catastral or numero catastral). If you are not sure where to find this information, normally is placed with your property deed.

Discounts on property Tax: Solidaridad

The property tax can be paid as of December 1, 2017, the discounts that apply are the following:

  • December 20%
  • January 15%
  • February 10%

The discounts do not apply to the payment of taxes of previous years, and discounts will not be made on surcharges for late payment. Solidaridad County  has a website in Spanish where you can check the amount of your payment for this 2018, as well as previous years and surcharges.

Life in a Condominium

How many times have we heard similar phrases from people who already bought their house in a private or condominium and say:

“I do what I want because it’s my house”

“I want to paint my house of another color so that it differs from the others”

“I’m going to put a roof on my parking lot “, etc.

It may seem to you that there is nothing wrong with any of these statements. Indeed there’s not any problem, there is nothing wrong with the owner wanting his house of a certain color; or making modifications to his parking lot. The problem is that when we buy a house in a private or condo we sign a contract. Therefore, at the time of the signing, we are accepting the regime of ownership in condominium of that private.

But, what is the condominium property regime?

In simple terms, condominium property regime is a document that regulates coexistence, urbanization, operation, modifications and administration of a condominium. This is what we understand as such to lots of land, departments, houses or premises constituted in a single plot of land. These properties or lands are governed under the same administration and therefore the same laws and regulations.

As a result, living in a condominium implies to follow a series of regulations that are part of the regime of property. These rules have as purpose to guarantee the healthy coexistence between owners.

It is important to consider this before making the decision to buy a house in a condominium. Basically, because we must be aware that even if we are the owners of the property, that does not give us the right to do what we want in our property. Inside it yes, but as for the facade and the outside, we must focus on doing what the regime of property in condominiums allows us to do.

Why Do We Buy With Bank Trust in Mexico?

You may have asked yourself what is the restricted zone and what is a Bank Trust. Also, why in order to own a property in Mexico you need to acquire a bank trust. The restricted zone is the territory located within 50 kilometers from the beach and 100 kilometers from the border.

To begin with the Article 27, section I of the Political Constitution of the Mexican States, reads as follows:

 “Only Mexicans by birth or by naturalization, and Mexican societies, have the right to acquire the dominion of lands, waters and their accessions, (…). The State may grant the same right to foreigners, provided that they agree with the Secretary of Relations to consider themselves as nationals with respect to such goods and not to invoke, as a result, the protection of their Governments, as regards those; under the penalty, in case of breach of the agreement, to lose to the benefit of the Nation, the goods that they would have acquired under it. In a belt of one hundred kilometers along the borders and fifty kilometers on the beaches, for no reason can foreigners acquire direct dominion over land and water. “

According to the Mexican law, a foreigner can only acquire a land within the restricted zone through two legal entities. These two methods that allow you to acquire a property are: Bank Trust and Mexican Corporation.

When the Mexican constitution was written it had the intention to protect this land. Also, to prevent the great loss of land that had occurred throughout history. In order not to amend the Mexican constitution, the Bank Trust was released to promote high-demand international investments; especially on the coast. Foreigners can acquire residential properties outside the restricted zone without a fiduciary. However, some buyers decide to obtain it.

What is a Bank Trust?

A Bank Trust is a document in which a foreigner entrusts the administration of his property to a fiduciary entity. Here we must understand that when buying through a Bank Trust, you as the buyer still own the property; the bank is simply an administrator of the same and has no right to dispose of the property. A Bank Trust will never represent a danger. The reason is that the bank won’t relate any of it’s legal problems to your property.

In addition to the Bank Trust, there is also the option of creating a Mexican Corporation. This would be for those who plan to acquire more than one property and/or open a business in Mexico. Nonetheless, this option is a little more complex as it has more requirements. Basically, it is important to consult with your real estate adviser to know which of the two suits you best.
